By accessing or using JustaCheck ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

JustaCheck is a wellness and safety check-in platform that allows users to monitor the well-being of their loved ones through automated check-ins via SMS, email, and app notifications. The Service is not a substitute for emergency services or professional medical care.

3. User Responsibilities

• You must obtain explicit consent from any person before adding them as a contact and sending them check-in messages.
• You are responsible for ensuring the accuracy of contact information you provide.
• You agree not to use the Service to harass, intimidate, or contact individuals without their consent.
• You are responsible for maintaining the confidentiality of your account credentials.

4. SMS and Communication Consent

By adding a contact's phone number to the Service, you confirm that you have permission to invite the recipient to receive automated text messages from JustaCheck. Before any recurring SMS messages are sent, the recipient must reply YES to a one-time consent request.

Types of messages sent include:

• Recurring wellness check-ins
• Medication reminders
• Safety and emergency notifications

• Message frequency varies based on your configured check-in schedule.
• Message and data rates may apply.
• Recipients may reply STOP at any time to cancel all messages.
• Recipients may reply HELP for assistance.
• Consent is not required as a condition of purchase.

5. Subscriptions and Payments

Certain features of JustaCheck require a paid subscription. Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

6. Disclaimer of Warranties

JustaCheck is provided "as is" without warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that messages will always be delivered. JustaCheck is not an emergency response service. In case of a life-threatening emergency, call 911 immediately.

7. Limitation of Liability

To the fullest extent permitted by law, JustaCheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to missed check-ins or delayed notifications.

8. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time by contacting us at support@justacheck.app.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
